President Joe Biden and Ben Meiselas, the polymath founder of MeidasTouch Network, believe the November election will be decided by democracy, decency and dignity.  

GOPutin has yet to grasp the ruling of Trump v Anderson, if democracy, decency and dignity prevail – especially for Wyoming.  Senator Lummis, and others, can be expelled from Congress by simple majority vote.

If America’s 2024 presidential voters hand control of Congress and the Presidency to Democrats, the 147 Republican representatives and 9 Republican senators who violated Section 3 of the 14th Amendment can be expelled – by legislation – from Congress, under Section 5 of the 14th Amendment. Trump v Anderson, IIB¶11, (2024) (Google Scholar). They refused to count electoral votes, as they had sworn to do, to aid and comfort enemies of the Constitution on 1 January 2021.  That violated Section 3 of the 14th Amendment. 

“Section 5 … must tailor … to remedying or preventing … the specific conduct the relevant provision prohibits … Section 3 … bars persons from holding office after taking a qualifying oath and then engaging in insurrection or rebellion. [Trump v. Anderson, Tr. of Oral Arg. 123] 

I wonder why you would read these words. But here we are, you and I, and for my part, it is enough if you find them useful.  

Before these words, I recently finished The Singularity Gene – Neanderthal Comedy, in order to finish HIAI (Human Intelligence Artificial Intelligence), started seven years ago, while serving as Strategic Counsel to the Jackson Hole Technology Partnership. Then Wyoming Governor, Matt Mead, founded the JHTP, as a privately-funded nonprofit to continually accelerate global access to frontier technologies, relevant to rural populations.

Before serving as Strategic Counsel, I received an LLM from NYU the year after I received a JD from the University of Wyoming College of Law. At NYU, I studied interpretative and constitutional theory under Professor Thomas Franck, as advised by John Sexton before he became an NYU president. I was asked to co-author an annotated reference to the Wyoming Constitution, later acquired and published by Oxford University Press. 

After NYU, I returned to Wyoming to clerk for the Chief Justice of the Wyoming Supreme Court, returning to Laramie to serve the people of Wyoming, while practicing appellate law nationally. After clerking, I was asked to write a monthly guest column for the Casper Star Tribune.  I wrote about state laws, judges, politicians and frontier technologies, for over a decade. I have been a registered Democrat in Wyoming since the early 1990s, except briefly to vote for Liz Cheney.

The story where I came face-to-face with Mr. Trump’s legal team follows below:

I petitioned to move the Court to expedite a hearing to judge his claims that Section 3 of the 14th Amendment of the United States Constitution and Article 1, §§ 6, 26, 36 and 37 and Article 5, § 10 of the Wyoming Constitution, separately and independently, preclude the names of Mr. Trump and Ms. Lummis from appearing on Wyoming ballots, take judicial notice of adjudicative facts under Rule 201 of the Wyoming Rules of Evidence, award judgment, enjoin such names from those ballots and award reasonable attorney fees and costs incurred in prosecuting this action.

The petition recited (1) facts cited by United States Special Counsel Smith in United States v. Donald J. Trump, In The United States District Court For The District Of Columbia Grand Jury Original Violations [Count IV charges violation of a federal death penalty statute]; the Final Report of the Select Committee to Investigate the January 6th Attack on the United States Capitol; Putin’s Asymmetric Assault on Democracy in Russia and Europe; Implications for U.S. National Security; and, the (U)Report of the Report 116-XX Select Committee on Intelligence United States Senate onActive Measures Campaigns and Interference in the 2016 U.S. Election Volume 5: CounterIntelligence Threats and Vulnerabilities and (2) adjudicative facts presented by media such as MTN, MSNBC, NPR, ABC, CBS, NBC, CNN and Fox. 

[1] Mr. Trump swore the oath to defend and support the Constitution of the United States as President of the United States of America against domestic enemies.  

[2] Ms. Lummis swore the oath to defend and support the Constitution against domestic enemies.  Before becoming a Wyoming attorney and, again, before becoming a United States Senator.

[144] The 116th United States Congress, scattered and bloodied by Mr. Trump’s terrorists, reassembled to fulfill their oaths to count the electoral votes commanded by the Constitution and certified the President-elect.  

[145] The Constitution survived this conspiracy to topple it, for now.

On 1 January 2024, the district court granted the Secretary’s motion to dismiss, without prejudice to refile when ripe. 

On 17 January 2024, I appealed the dismissal.

On 4 March 2024, the United States Supreme Court ruled that only Congress may bar federal office-holders from the ballot and state can remove state officer-holders from  ballots,for violating Section 3 of  the 14th Amendment. 

On 21 March 2024, I filed to dismiss the appeal in conformity with Trump v. Anderson.

On 25 March 2024, the Wyoming Supreme Court granted voluntary dismissal of the appeal.

Nyla prevailed within weeks.
